🔹 संज्ञेय अपराध क्या है?

ऐसा अपराध जिसमें पुलिस बिना वारंट के गिरफ्तार कर सकती है और स्वयं जांच शुरू कर सकती है। 
जैसे –चोरी , हत्या, बलात्कार, डकैती, अपहरण आदि।

🔹 FIR कैसे दर्ज कराएं?

  1. निकटतम थाने में जाएँ

  2. घटना की पूरी जानकारी दें (तारीख, समय, स्थान, आरोपी का नाम ,पता आदि)

  3. पुलिस आपकी बात लिखेगी

  4. लिखित रिपोर्ट को पढ़ें

  5. सही होने पर हस्ताक्षर करें

  6. FIR की कॉपी निःशुल्क लें (यह आपका अधिकार है)

🔹 अगर पुलिस FIR दर्ज न करे तो?

  1. संबंधित थाना प्रभारी से लिखित शिकायत दें

  2. पुलिस अधीक्षक (SP) को आवेदन दें (BNSS धारा 173(4))

  3. मजिस्ट्रेट के पास आवेदन कर सकते हैं (धारा 175 BNSS के तहत आदेश हेतु)

🔹 Zero FIR क्या है?

यदि अपराध किसी अन्य थाना क्षेत्र में घटित हुआ हो, और आप किसी दूसरे थाने में रिपोर्ट दर्ज करा रहे हैं ऐसी स्थिति में FIR जीरो में दर्ज होगा । और बाद में वह रिपोर्ट संबंधित थाने को भेज दी जाती है। इसे Zero FIR कहते हैं।

🔹 FIR का महत्व (Exam Point – LLB के लिए)

  • आपराधिक प्रक्रिया की शुरुआत FIR से होती है

  • यह साक्ष्य का महत्वपूर्ण दस्तावेज है

  • FIR में देरी होने पर अदालत संदेह कर सकती है

  • FIR substantive evidence नहीं है, लेकिन corroborative evidence के रूप में उपयोग होती है
